Terms of Use for the “Mark Up” App and Websit​

1. Scope​

These General Terms and Conditions (GTC) govern the use of the “Mark Up” app and the associated website. By registering or using the app or website, users agree to these GTC.

2. Description of services​

“Mark Up” is a digital platform for motivation and personal development through achievements, tutorials, and challenges. There is no entitlement to specific functions, content, or permanent availability. The operators reserve the right to change, restrict, or discontinue content, functions, or parts of the service at any time.

3. Registration and user account​

(1) Certain functions require the creation of a user account.
(2) A user name must be provided during registration.
(3) Users are prohibited from using illegal, offensive, or misleading content as their user name or profile text.
(4) There is no entitlement to registration or permanent maintenance of a user account.

4. User obligations​

Users undertake in particular:

  • not to disseminate illegal content,
  • not to infringe the rights of third parties,
  • not to misuse the platform,
  • not to circumvent technical protection measures,
  • not to manipulate achievements or system functions. In the event of violations, the operators reserve the right to remove content or block or delete user accounts.

5. Content and achievements​

Achievements and other content serve as motivation and for personal development. There is no entitlement to specific successes or results. Activities are carried out on one's own responsibility.

6. Liability​

(1) The operators are liable without limitation in cases of intent and gross negligence.
(2) In cases of simple negligence, the operators are only liable for breaches of essential contractual obligations (cardinal obligations) and limited to the foreseeable damage typical for this type of contract.
(3) Liability for damages resulting from injury to life, limb, or health remains unaffected.
(4) Any further liability is excluded.

7. Availability​

There is no entitlement to uninterrupted or error-free availability of the app or website. Maintenance work, technical malfunctions, or further developments may lead to temporary restrictions.

8. Changes to the Terms and Conditions​

The operators reserve the right to change these Terms and Conditions with future effect if this is necessary for objective reasons. Users will be informed of any significant changes in an appropriate manner.

9. Termination​

Users can delete their account at any time. The operators are entitled to block or delete user accounts in the event of violations of these Terms and Conditions or for legitimate reasons.

10. Applicable law​

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
